In our horizon scan of what’s coming up in 2024 Alessandra Gettins, Employment Partner, and Neil Bhan, Pensions Partner, will cover a range of topics including:

 

  • Brexit: the end of EU law supremacy and the implications for employment law.  This will include amendments to TUPE, the Equality Act and the Working Time Regulations.
  • Legislative changes: including changes to the flexible working regime, extension of protection of pregnant employees, additional leave entitlements and the duty to prevent sexual harassment.
  • Case law: recent key case law including Miller v Bristol University (freedom of speech), Miss AB v LB of Kingston (trans rights) and PSNI v Agnew (holiday pay)
  • The costs of funding participation in the Local Government Pension Scheme for employers facing financial pressures

Neil Bhan

Neil leads Capsticks’ Pensions team. He advises on all aspects of pensions law, with a specific focus on public sector pensions, including the Local Government Pension Scheme. 

Neil has extensive experience in pensions-related work, including public sector pension issues, sponsoring employers, advising on regulatory and governance issues, corporate transactions, pension scheme mergers, and investment and custody agreements.

His corporate experience includes dealing with underfunded schemes, allocation of pensions risk on TUPE transfers and transactions, the Pensions Regulator, and advising on contingent assets, guarantees, recovery plans and other scheme funding issues.

Neil also deals with buy-outs, buy-ins, escrow arrangements, and section 75 issues including withdrawal and apportionment arrangements.

Alessandra Gettins

Aley is a Partner in the employment and pensions department, managing a team of lawyers providing the full range of employment law advice to health, police, fire and social care clients.

Aley has a particular focus on working with emergency services and local government clients, leading the firm’s development of these sectors in the employment team.

Aley's expertise are in issues arising from the implementation of GDPR in relation to workforce matters, workforce streamlining, collaboration and efficiency projects. She also regularly advises on contractual pay disputes, including several large scale multi-party disputes concerning national terms and conditions.

Aley has also successfully conducted numerous employment tribunal cases, ranging from unfair dismissal to more complex trade union and discrimination claims.
