LLG Midlands Regional Meeting - 17th September 2025

The focus of this meeting will be on Planning in relation to the Court of Appeal Ruling on the Bell Hotel and use of injunctions. Why the council brought the case, what the ruling said, what this means for other councils and can the council make a direct application to the Supreme Court now the appeal has been refused. 

We will be joined for this meeting by Rory Stacey from Trowers & Hamlins who will go into detail on:

  • Background to the case and decision of High Court to grant injunctive relief;
  • Planning law aspects of the case:
    • Material change of use?
    • Appropriate use of enforcement powers?
  • Summary of law on injunctive relief
  • Why did the Court of Appeal disagree with the High Court?
  • Where does the case leave local authorities in similar cases and enforcement cases more widely?

Rory Stracey, Partner

Rory specialises in all aspects of planning, highways and compulsory purchase law.

Before joining Trowers & Hamlins, Rory worked across both the private and public sectors, most recently as the Principal Planning & Corporate Lawyer for the London Borough of Hillingdon.

Rory has a wealth of experience having lead on a wide range of major development and regeneration schemes including mixed-use developments, large-scale housing schemes, commercial developments as well as infrastructure projects. Negotiating complex S106 and Highways Agreements, dealing with compulsory purchase orders, and mitigating the risks on planning applications - Rory is able to advise on planning, highways and compulsory purchase matters from start to finish.

Rory also has extensive experience in contentious planning, having acted as advocate in a wide range of planning inquiries and appeals. He has a wealth of experience in advising on judicial review claims in the High Court, acting for both claimants and defendants.

Rory is recommended in The Legal 500 2015.

Michael Green, Partner

Michael is a Partner and leads the Property Litigation team in the Trowers & Hamlins Birmingham office. 

He is an expert in contentious property matters and his clients include local authorities, not-for-profit organisations, pension funds, property investors, developers and corporate occupiers.

Michael has a particular specialism in advising portfolio owning clients in respect of lease terminations and redevelopment / regeneration projects, ranging from single-unit assets to £200m multi-unit schemes.

Michael understands the practical and commercial way in which clients need contentious property matters to be handled, and he delivers his advice accordingly.
