Responding to Casey – Legal Professional Privilege and what comes next in safeguarding and CSE.

Baroness Casey’s Child Sexual Exploitation ( CSE) audit has led to the announcement of a national “whole system” inquiry.

This will mean scrutiny of how all manner of public bodies including care providers, schools, police, health and others have dealt with reports, concerns and signs of sexual exploitation in their areas. This isn’t just a concern those councils with children’s social care departments. For example,  a whole chapter of the Casey audit considered the role that taxis might play in putting children at risk of CSE, and she reported that around 70% of group-based offenders were employed in the nighttime economy.  

Given the criticisms some lawyers faced Legal privilege used to 'cloak' messages, admits key Post Office figure Angela van den Bogerd | Law Gazette  within the Post Office scandal it is important that MOs ensure legal involvement is correctly engaged, not simply so discussions have the ‘cloak’ of privilege.   The Post Office scandal shows how privilege can be misused or be perceived to have been misused. In the IICSA inquiry, a number of organisations concluded it was appropriate to waive privilege, often following public scrutiny and criticism.

We therefore propose to use this session to

  • Address the most common questions likely to be asked of Lawyers about the inquiry
  • Reflect on what we know about the Casey Audit and what the likely terms of reference will be
  • Support local authorities to gather, store and share both data and personal information safely
  • Provide insight and guidance on the ethical application of Legal Professional Privilege and the consequences when it is waived, sometimes years after the fact

Sarah Erwin-Jones, Partner

Sarah is the leading lawyer on redress, abuse and assault claims for Browne Jacobson. Recognised by the Legal 500 since 2015 as a standout expert in child and adult abuse claims, as well as safeguarding advice, Sarah has a particular interest in working with social care, sports and faith organisations as well as many charities.      

As a result of her experience, Sarah has been asked to give evidence and advise clients in responding to public inquiries.  She dealt with the personal injury claim that followed the tragic death of Victoria Climbié and has been involved in a number of high-profile group actions, taking cases to the Court of Appeal and Supreme Court.   

She advises clients on risk management, child protection, human rights, public inquiries, redress schemes and Data Protection Act issues.

Stephanie McGarry, Partner

Stephanie specialises in regulatory law with a particular focus on large and complex public inquiries / corporate manslaughter and HSE investigations. She is ranked in Chambers for Health and Safety. Her breadth of knowledge across the regulatory field makes her an invaluable source of expertise for clients.

Stephanie has advised in respect of numerous fatal and non-fatal accident criminal investigations in connection with a variety of industries. This includes deaths on construction sites, agricultural sites, in educational settings and in NHS and local authority premises. She has acted in relation to the Hillsborough inquests, the Grenfell Tower Inquiry and the Covid-19 Inquiry.

She assists clients with disclosure exercises for the purposes of coroners’ inquiries and police / regulatory investigations and regularly appears before coroners’ and magistrates’ courts as an advocate. She regularly attends interviews under caution with the Health and Safety Executive and the police.
