This course will provide attendees with a solid understanding of the key principles and procedure relating to premises closure orders. It will include the relevant legislation, evidence, case law and procedure, giving attendees the opportunity to work through a case study to consider the typical scenarios in which a closure order may be sought. The course will cover:

  • Who can apply and what types of closure order can be made

  • Typical scenarios in which a closure order may be sought

  • The legal test for obtaining a closure order

  • Criminal behaviour

  • Serious nuisance

  • Disorder

  • Necessity

  • Evidence – use of statements, photographs and plans etc.

  • The first hearing in the magistrates’ court

  • Directions, disclosure and defences in closure cases

  • Witness care

  • Final hearings in the magistrates’ court

  • Service of notices and orders

  • Offences associated with closure orders

  • Useful case law

  • ASBIs and possession proceedings associated with closure orders

  • Costs and other consequential orders

This course is aimed at anyone dealing with anti-social behaviour and community safety within a local authority, including community safety officers, housing officers and those dealing with licensing.
