This course will provide solid, practical guidance on running cases in the Court of Protection. It will cover:

  • The law and guidance, including the relevant provisions of the Mental Capacity Act 2005 and the Care Act 2014, as well as their accompanying guidance.

  • Key cases on the application of the provisions of the Mental Capacity Act 2005 and the Care Act 2014.

  • Section 21A challenges and how to respond to them.

  • Applications under section 16 of the Mental Capacity Act 2005 on Health and Welfare matters.

This course is suitable for practitioners working in adult social care within a local authority.

Laura Mitchell-Ghafoor is a solicitor who qualified into industrial disease work in April 2016 following seats including personal injury and costs. She moved to a Local Authority where she has predominantly undertaken Court of Protection work since 2019. In the in-house role she regularly advises on queries relating to the Mental Capacity Act 2005, Care Act 2014 and related local government matters as well as advising and advocating in cases in the Court of Protection. Laura completed the Higher Rights of Advocacy (Civil) Course in 2022.
